1. Acceptance of Terms

By accessing or using OpenToServe ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

OpenToServe reserves the right to update these Terms at any time. We will notify registered users of material changes via email. Continued use after changes constitutes acceptance.

2. The Platform

OpenToServe is a marketplace that connects on-demand hospitality workers ("Workers") with restaurants, bars, cafés, and other hospitality venues ("Businesses"). We facilitate the connection — we are not an employer, staffing agency, or employment broker.

Workers are independent service providers. OpenToServe does not control how, when, or where Workers perform their services beyond the shift details agreed upon through the Platform.

3. Eligibility

To use OpenToServe, you must:

  • Be at least 18 years of age
  • Be legally authorized to work in the United States
  • Provide accurate, complete information during registration
  • For Workers: hold any certifications or licenses required for the roles you claim (e.g., state barber license, food handler certification)
  • For Businesses: have the legal authority to represent the business and post shifts on its behalf

4. Account Responsibilities

You are responsible for maintaining the security of your account credentials. You must notify us immediately if you suspect unauthorized access to your account.

You agree to provide truthful, accurate information in your profile. Misrepresenting your skills, certifications, or identity may result in account suspension or permanent removal.

5. Worker Responsibilities

As a Worker on OpenToServe, you agree to:

  • Only accept shifts you intend to complete
  • Arrive on time and perform the role to professional standards
  • Comply with all applicable laws, including food safety and alcohol service regulations
  • Maintain valid certifications for roles that require them
  • Cancel shifts through the Platform with reasonable notice if you cannot attend

Repeated no-shows, late cancellations, or unprofessional conduct will negatively impact your reliability score and may result in account suspension.

6. Business Responsibilities

As a Business on OpenToServe, you agree to:

  • Post accurate shift details including role, time, and pay rate
  • Provide a safe working environment for Workers
  • Pay Workers for completed shifts at the agreed-upon rate through the Platform
  • Not contact Workers outside the Platform to circumvent fees
  • Rate Workers honestly and professionally

7. Payments & Fees

Workers are paid for completed shifts according to the terms displayed at the time of shift acceptance. OpenToServe charges Businesses a platform fee on each completed shift.

Specific pricing is displayed at the time of shift posting and confirmation. Businesses are not charged for shifts that are not completed.

8. Cancellations & No-Shows

Workers who cancel a shift after confirming or fail to show up will have their reliability score impacted. Repeated violations may result in temporary or permanent account suspension.

Businesses who cancel a confirmed shift may be subject to cancellation policies designed to protect Workers who have committed their time.

9. Content & Conduct

You retain ownership of content you submit to the Platform (photos, descriptions, etc.) but grant OpenToServe a non-exclusive license to use it for operating and promoting the Platform.

You agree not to:

  • Post false, misleading, or fraudulent information
  • Harass, threaten, or discriminate against other users
  • Attempt to circumvent the Platform to avoid fees
  • Use the Platform for any unlawful purpose
  • Scrape, crawl, or use automated tools to extract data from the Platform

10. Limitation of Liability

OpenToServe provides the Platform "as is" without warranties of any kind. We do not guarantee that shifts will be filled, that Workers will perform to any standard, or that Businesses will provide a specific work environment.

To the maximum extent permitted by law, OpenToServe's liability is limited to the fees paid through the Platform in the 12 months preceding any claim.

11. Termination

You may close your account at any time by contacting us. OpenToServe may suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a risk to the community.

12. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or class action.

13. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to conflict of law principles.
